AREAS OF RESPONSIBILITY
Anti-Counterfeit Infrastructure
• Complete strategy management on leads received from business for counterfeited products/any kind of unauthorized use of our brands (including but not limited to discussion with concerned teams, mapping expectations and issues, scale of problem, impact analysis, investigation plan, enforcement action and closure of the case)
• Monitor reports and activities of investigators to conduct anti-substitution surveys, market inspections and enforcement actions in select jurisdictions. Advise investigators on startegy to be adopted for such surveys and also confirming the brands and outlets to be covered. Advise investigators on post survey action on infringing outlets.

• Develop Internal intelligence gathering and accordingly conduct investigations on the basis of intelligence obtained from internal stakeholders via awareness generation amongst them for counterfeits
• Engage in conducting trainings for internal stakeholders to educate them about counterfeit products and make them a part of intelligence gatherance network to fight against counterfeits
• Involve, engage and protect our products by end to end product security management as per the risk matrix of counterfeit activities happening against a particular brand. This involves coordinating and working closely with the brand change team for new-anti counterfeit technology to be adopted for such a brand and conducting due diligence/reveiw of the supply chain security management of the brand involved.
• Monitor the data captured through the hot line number amongst the internal stakeholders for lead generation and intelligence gatherance
• Lead and conduct enforcement action strategy on identified targets depending on parameters of jurisdiction, enforcement authority, ROI and NSV of brand involved
• Work closely/tandem with the Legal and IP team members for final strategy to be adopted against the infringing party for specific stakeholders/expectation of stakeholders (For example-If stakeholder wants to only warn the other party and not conduct any criminal action against them then we would advise/recommend the IP team to do the needful post conducting the investigation)
• work with the technology team in Diageo india and Diageo Global to implement the right technologies for the products to prevent counterfeiting.
Stakeholder Engagement
• Engage with Government authorities for pushing our anti-counterfeit agenda including but not limited to conducting enforcement actions, creating awareness about issues faced by counterfeits, strengthening the legal provisions in concerned Excise legislations.
• work with the Global Brand protection team in Diageo to align the brand protection strategy for India and also closely work with them to update them on progress and India specific requirements.
• Impart training/s and awareness programs to Government authorities to distinguish between counterfeits and originals and how to deal with cases related to counterfeit products
• Impart training/s to internal stakeholders (primarily commercial teams) during induction session of new joinees, monthly sales meet to help them distinguish between counterfeits and originals and also how to report about such issues to the BP team
• Collaborate and partner with FICCI-BASCAP, CII, ISWAI, CIABC for Industry anti-counterfeiting initiatives
• work closely with other alcohol companies under the aegis of ISWAI or independently to devise a strategy on working together for combatting counterfeiting
• Play a role of coordinator to ensure the right message has been communicated to the right person at the right time. This is inclusive of communicating with internal and external parties
• Monitor and ensure that all relevant stakeholder concerns/issues have been taken into account and accordingly addressed (includes external as well as internal stakeholders)
• Responsible for creation of a task force known as Brand Protection Working Group (within the company) comprising of various internal stakeholders i.e., commercial, finance, corporate relations, brand change etc., for driving and approving the larger agendas of the BP team.
• Responsible for ensuring that the BPWG agenda is drawn out and implemented in a timely fashion.
Reports & Recommendations
• Monitor master database of end to end case management
• Monitor master database of enforcement actions
• Conduct annual performance review of vendor and create report post discussion with Head of Department
• Approve all cases uploaded in CORE database
• Recommendations to be made for contents of Brand Protection related provisions in MSA entered with the vendor
• Approve and monitor the investigation plans related to each case involved
• Check and reassess the budget monetary report
• Approve and check all internal and external presentations being made to be presented to concerned stakeholders
• Responsible for making any changes/amendments to the Brand Protection Policy for Diageo India
Vendor Compliance Responsibilities
• Arrange and coordinate for COBC training of Service Provider/s with the legal team
• Conduct product trainings (to distinguish between counterfeit and originals) for service providers
• Brief all the Service providers about our Code and how to conduct business in a ethical manner as prescribed under our company policy during the product training session
• Undertake periodic audits of the agencies to check compliance
Provide the service providers with relevant material/documents with respect to compliance requirements of the Company
Public Policy Advocacy
• Partnering with Govt relations for Public Policy interventions highlighting best practice of legal provisions with respect to counterfeits and illicit in each jurisdiction to influence such changes in the local provisions
• Prepare white papers for circulation/spreading awareness of best practices to tackle the issue of counterfeits/illicit liquor in various jurisdictions .
