Job Description
The Massachusetts Gaming Commission (MGC) seeks to hire an Attorney to work as Senior Enforcement Counsel, within the MGC's Investigations & Enforcement Bureau (IEB), a law enforcement agency. Under the direction of the Chief Enforcement Counsel, the Senior Enforcement Counsel will work in collaboration with the MGC's Licensing Division and the Massachusetts State Police (Gaming Enforcement Unit), as well as the IEB's Financial Investigations Unit and Civilian Investigators. This position will be responsible for performing background reviews of individuals and gaming vendor companies, who are seeking qualification or licensure for employment at, or sell goods and/or provide services to any of the casinos in Massachusetts.

Duties and Responsibilities include, but are not limited to:
• Acquire and maintain knowledge of the Massachusetts gaming and sports wagering laws, regulations, and issues that impact suitability for licensure and registration of casino employees and vendors to casinos as well as those who hold sports wagering licenses.
• Develop and manage timelines for completing investigations of applicants for gaming and sports wagering vendor licensure.
• Review and prepare Suitability Reports pertaining to high level casino employees, gaming vendors and sports wagering licenses.
• Prepare adverse action letters for applicants, licensees, and registrants who are disqualified or may be unsuitable for licensure or registration under Massachusetts law.
• Prepare and present cases for hearings before an impartial hearings officer, including preparation and introduction of exhibits, witness preparation and examination, briefing where necessary, and opening statements and closing arguments.
• Draft briefs on behalf of the IEB when a party (either the licensee/applicant/registrant or the IEB) seeks review by the Commission of a decision of the hearings officer.
• Work in collaboration with the Commission staff from the Gaming Agents Division and the Mass. State Police to prepare notices of violation and enforcement actions, including the assessment of civil administrative penalties, to address casino noncompliance matters.
• Works directly with casino management towards informal disposition of adjudicatory proceedings by way of agreed settlements in appropriate circumstances and in accordance with gaming regulations.
• Perform research and analysis on legal issues impacting the IEB on an as-needed basis.
• Assist with identifying and managing areas of risk to the IEB in the licensing, registration, and adverse action process.
• Draft notices of exclusion from gaming and sports wagering in Massachusetts.
• Work collaborating with the Sports Wagering Division on sports wagering noncompliance matters, including making recommendations for civil administrative penalties, conducting investigations into the noncompliance, and serving as a party and presenting findings at an adjudicatory hearing.
• Oversee and manage durable suitability investigations into Sports Wagering operators.
• Work collaboratively with Commission staff, including members of the Mass. State Police assigned to the Gaming Enforcement Unit, the IEB's civilian financial investigators, the Gaming Agents, the IEB's Paralegal, and the Commission's Licensing Division to reach well-reasoned determinations that comport with the gaming law's legal and policy objectives.
• Act as a mentor to Enforcement Counsel.

Qualifications

• Competence in computer usage and standard software including Microsoft Windows, word- processing, spreadsheet, project management, and database software.
Experience, Education, and Training:
• A J.D. Degree from an accredited law school and a license to practice law in Massachusetts.
• At least eight years of legal experience working in a governmental agency or law firm.
• Experience in managing a team in a legal and investigative setting.
• Law enforcement and administrative law experience preferred.
• Gaming Experience preferred.

The MGC offers a hybrid work environment and requires staff to work at least two days in the Boston Office. Based on business needs, additional in-office days may be required.
Salary is commensurate with experience.
The successful candidate must pass an extensive background check conducted by the Massachusetts State Police. It includes a full credit check, CORI (Criminal Offender Record Information), fingerprinting, drug test, reference checks, review of IRS Income Tax Transcripts for the last four years, and a Certificate of Good Standing from the Massachusetts Dept. of Revenue (DOR).
The Massachusetts Gaming Commission is responsible for the implementation of the expanded gaming law (Chapter 194 of the Acts of 2011) and regulatory oversight of G.L. chapter 23K (casino gaming), chapter 23N (sports wagering), and chapter 128A (horse racing). Under these laws, the Commission is tasked with establishing a regulatory framework for the solicitation, licensing, taxation, and oversight of a maximum of three casino licenses and one slots parlor only license, the provision of in-person and digital sports wagering, and the live and simulcasting of horse racing in Massachusetts.
