Bureau Overview:

The Litigation Bureau represents the Commissioner in tax-related litigation matters before the Appellate Tax Board and various state and federal courts, including the United States Bankruptcy Court, Massachusetts Appeals Court and the Supreme Judicial Court (under the appointment of the Department's General Counsel as a Special Assistant Attorney General). Our mission is to provide the highest quality legal representation to the Department and to ensure the tax laws are enforced in a vigorous, fair and even-handed manner. Position Summary:

The Department of Revenue (DOR) seeks a Deputy Chief for its Litigation Bureau. The incumbent will supervise the trial attorneys and support staff of the Bureau. Successful candidates will have a combination of significant trial and/or appellate experience, sound judgment, strong interpersonal skills and the ability to marshal, manage and delegate tasks in a timely manner.

Duties and Responsibilities

The incumbent's primary responsibilities are to supervise a staff of attorneys of the Litigation Bureau and to ensure that Litigation Bureau employees have the tools necessary to assist them in the Department of Revenue's mission of enforcing the tax laws of the Commonwealth in a consistent, transparent, objective and fair manner. This requires:

  • Understanding of the various tax, procedural and litigation issues Litigation Bureau attorneys confront in their cases.
  • Providing guidance to Litigation Bureau attorneys as to litigation strategy and appropriate resolution of litigation matters.
  • Assigning appropriate attorneys to cases based on their respective skill sets.
  • Consulting with Bureau attorneys (and with the Chief of the Litigation Bureau, Associate General Counsel, General Counsel and others as appropriate), and reviewing and commenting on settlement memoranda to arrive at appropriate resolutions of cases.
  • Interacting closely with employees in other DOR bureaus to ensure consistency in case development and tax policy.
  • Working with Bureau attorneys with regard to disclosure matters and public records requests.
  • Ensuring Litigation Bureau attorneys and staff are provided the tools to succeed and opportunities for career development, for example: supporting requests of attorneys to hire experts when necessary to assist on cases, advocating for training opportunities, and ensuring effective processes for case administration.
  • Working closely with the Litigation Bureau's Chief, Deputy Chief and Office Managers to be sure the various administrative requirements of the Litigation Bureau are met.

As part of the Future of Work Initiative, the agency is adopting a hybrid work model. Hybrid work is a mix of in-office work and telework. This position will work remotely some days and in-person on other days.

An external candidate recommended for a position with the Department of Revenue will be subject to an extended background check by the agency and the Executive Office of the Governor that includes checks for: state and federal tax compliance; child support compliance; education verification; Massachusetts CORI checks; criminal background checks in state(s) of current and previous residence/employment; validation of eligibility to work in the United States; and national fingerprint-based criminal background checks.

Qualifications

MINIMUM ENTRANCE REQUIREMENTS:

Applicants must have at least (A) six (6) years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in a particular specialty (i.e. scientific, professional, or technical) and must possess current license and/or registration requirements established for the performance of the position, of which (B) at least two (2) years must have been in a project management, supervisory or managerial capacity or (C) any equivalent combination of the required experience and substitutions below.

Substitutions:

I. A certificate in a relevant or related field may be substituted for one (1) year of the required (A) experience.

II. A Bachelor's degree in a related field may be substituted for two (2) years of the required (A) experience.

III. A Graduate degree or higher in a related field may be substituted for three (3) years of the required (A) experience.

IV. A Doctorate degree in a related field may be substituted for four (4) years of the required (A) experience.
