Position Summary:
The Office of the General Counsel advises the Commissioner and others within the department on all aspects of tax and administrative law. The Office seeks an experienced attorney for its Administrative Law Unit. The successful candidate will draft, negotiate and review various contracts for DOR, including procurement documents, data exchange agreements with other states agencies and the IRS, as well as IT Statements of Work. In addition, this attorney will assist the agency in the review of any unauthorized access or use of DOR information to determine if notification letters are needed and will assist DOR's Federal/State Exchange with disclosure and IRS requirements. This position requires thoughtful consideration of various administrative law questions arising within the agency, including questions related to departmental policies, conflict of interest laws, use of SSNs on forms, visa issues, etc.

Duties & Responsibilities:
Within the agency, the Counsel II will:
• Provide legal advice and assistance to internal groups within DOR, such as the Administrative Affairs Division (AAD), Procurement, ANF-IT Support and Tax Administration.
• Assist with interpretation of IRS disclosure rules to ensure DOR's compliance with IRS Pub. 1075.
• Supports AAD in its review of unauthorized access or uses of DOR information to determine if breach notification letters are needed.
• Partner with the General Counsel and the Deputy Counsel to respond to non-tax inquiries from DOR, state agencies and other third parties.
On behalf of the agency, Counsel II will:
• Work with other state agencies and entities to ensure that DOR complies with all procurement laws and regulations.
• Collaborate with other state agencies and entities to determine if data exchanges are authorized and properly documented in agreements containing DOR's confidentiality and security requirements.
Required Qualifications & Abilities:
Ø Conduct legal research and draft documents.
Ø Read and interpret legal documents and apply the law, rules and regulations governing agency operations.
Ø Exercise discretion and sound judgement, particularly in safeguarding information through compliance with disclosure law.
Ø Interact effectively with diverse groups of people.
Ø Communicate effectively, both verbally and in writing, to clearly and concisely express thoughts and develop ideas in a logical manner.
Ø Utilize a computer to conduct research, manage databases, and produce written documents.
Ø Lead or work with cross-functional projects teams and manage multiple projects and project teams.
As part of the Future of Work initiative, the agency is adopting a hybrid work model. Hybrid work is a mix of in-office work and telework. This position will work remotely some days and in-person on other days.
An external candidate recommended for a position with the Department of Revenue will be subject to a background check that includes checks for: state and federal tax compliance; child support compliance; education verification; Massachusetts CORI checks; criminal background checks in state(s) of current and previous residence/employment; validation of eligibility to work in the United States; and national fingerprint-based criminal background checks.

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.
Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
