This is a pipeline position that will be opened on a recurring basis and used to fill roles aligned with the required skill sets. Recruiting efforts will be ongoing until specific teams find an ideal match.

Remote position

NetApp's Legal department is looking for a senior employee relations investigator with deep EMEA and AMER regional employment law knowledge and global investigations experience with primary focus in the US, UK, Ireland, Germany, Netherlands, France, Israel, and UAE. In this role, you will serve as a lead investigator independently handling your own caseload across these regions and provide expert-level consultation and resolution of employee relations issues and conflicts. In addition, you will help lead the development of the EMEA ER function and peer mentor junior investigators. You will also be responsible for maintaining case management systems and trackers across global regions, refining consistent and streamlined processes, developing and delivering proactive trainings, utilizing data trends in innovative ways for the benefit of the function and business, and partnering with HR to improve systems around performance management, RIFs, and other projects.

Key Responsibilities

Global ER Investigations and EMEA ER Lead
• Manage complex employee relations related investigations with limited supervision, end-to-end 80-85% of the time, including allegations of discrimination, harassment, retaliation, bullying, misconduct, bias, and other inappropriate behavior across NetApp locations within the EMEA and AMER regions.
• Design, develop, and implement ER processes, procedures, and organizational design in EMEA in partnership with Legal, HRBPs, and Ops, as the ER lead in that region.
• Demonstrate a strong understanding of, and dedicated adherence to, confidentiality, neutrality, and other employment law and workplace investigations best practices.
• Exercise strong professional judgment, emotional intelligence, and collaborative communication with investigation parties and cross-functional partners in HR, Legal, and the business.
• Articulate findings to the business in the form of fact-based conclusions and recommendations that look towards broader organizational health improvements and long-term solutions that fix root cause issues.
• Capacity to handle high-level cases and manage a volume of 20+ cases at any given time in addition to assisting regional HRBPs with other workstreams and projects as needed.

Case Management, Training, Conflict Resolution, and Other Projects
• Coach and execute on best practices in performance management, RIFs, organizational design, and other separation issues.
• Develop and deliver training content and programs for various audiences using cutting-edge learning and development modalities on topics including compliance policies, performance management, employment law, manager learning and development, and effective conflict resolution and communication best practices.
• Organize and direct global case management compliance initiatives in Navex Ethics Point, discern systemic issues, and creatively utilize data to help develop long-term and proactive solutions.
• Practical experience with conflict resolution consultation, coaching, collaborative problem-solving, and mediation to resolve workplace conflict effectively between employees and managers.

Job Requirements

• Experience leading the development of an EMEA ER function, global investigations, and advising on employment-related matters across EMEA and AMER.
• Experience independently conducting, documenting, and presenting thorough and fair investigations that will withstand legal scrutiny and promote consistency across multiple jurisdictions.
• Advanced skills in presenting investigation findings and other guidance at an executive level and influencing leadership to adopt best practices.
• Proven ability to work independently, act on priorities, and exercise proven judgment around key issues and identifying legal risk.
• Collaborative relationship management and expert communication skills to effectively navigate a highly cross-functional environment.
• Strong problem-solving, analytical, critical thinking, and organizational skills with great attention to detail, a growth mindset, and ability to adapt in rapidly changing environment.
• Learning and development, performance management, and project management experience highly valued.
• Familiarity with facilitation, mediation, and conflict resolution is helpful.

Education

• 12 years relevant experience required
• JD, LLB, or other related degree and experience practicing labor and employment law or resolving high-level employee relations cases
• Formal training and/or certifications in workplace investigations and/or HR preferred
• Prior leadership and people management experience preferred.
