Job Description

Primary Function of Position

With experience and vision, serve as Contract Negotiator for Intuitive Surgical’s Taiwan operations, which is a high growth leader in the medical device industry. The Contract Negotiator will provide contract negotiation to our Taiwan team, a subsidiary of Intuitive Surgical, an US based parent corporation. The position will manage a variety of contractual topics including tenders, for a wide range of stakeholders. This “hands on” position requires drafting and negotiating contractual terms and conditions with customers and/or other third parties to ensure company and legal compliance in the sales of Intuitive’s products and services, in a high-pressure environment under tight deadlines. S/he will require the ability to multi-task, prioritize and work proactively to meet internal and external deadline demands.  Some travel may be required.

Essential Job Duties

  • Draft, analyze, review, and negotiate agreements and sales contracts that establish business relationships with customers and/or partners for Intuitive Taiwan operations whilst ensuring compliance with company policy, government regulations, revenue recognition. These can include training, proctoring, leasing, public tender, and other miscellaneous agreements and negotiation.
  • Interact directly with administrators and, purchasing personnel and attorneys, who are representing Intuitive’s customers and distributors.
  • Work closely with Contracts, Sales, Customer Service, Accounting, and logistics teams on the system and instrument sales process. Timely tracking of contract status review process to avoid any delay of the execution of contracts
  • Assist instrument sales and Service Contract drafting, reviewing, redlining, finalizing, support the negotiations when required.
  • Provide necessary basic legal/ Contract information and training to relevant employees and managers
  • Provide advice and counsel to Taiwan Intuitive Surgical’s operations with focus from the contract  perspective, working with internal counsel as required.
  • Drive continuous improvements among activities of all functions involved in sales contract and lease process.
  • Support government tender process from contract negotiation and legal perspective.

Qualifications

Required Skills and Experience

  • Minimum 3 years experience in medical device or pharma industry, or in life science department of a law firm.
  • Working experience in Multi-National Companies is a must
  • Working experience in Public Procurement (tender) is a must
  • Strong English with excellent oral and written communication skills at various organizations levels. Fluency in Chinese, Taiwanese is also required.
  • Strong legal contract drafting and negotiation skills, including experience in commercial agreement matters.
  • Ability to influence cross functionally, internally and externally.
  • Good business sense, organizational and problem solving skills.
  • Proactive, a high degree of professionalism and a motivation to work independently.
  • Detail oriented, organized and able to manage multiple tasks simultaneously within a rapidly changing environment.
  • Coach other department team members and determine best way for the business
  • Open to occasional domestic and international business trips

Required Education and Training

  • Minimum Law degree (LLM a plus).
