About the role:

  • Legal input is needed on Tequila & Mezcal, in the Expansion, Agriculture and Manufacturing businesses, mainly in strategic relationships, efficiency, innovations, and our spirit of progress agenda, which will be connected to corporate relations, compliance, security, and business integrity challenges.
  • There are numerous legal, business, and regulatory risks to be managed.
  • The regulatory environment is sophisticated, especially with the CRT, COMERCAM, among others, as Diageo has various operational sites and exports to the rest of the world, as well as numerous relationships with TPO's. Legal advice is key to guarantee the regulatory legal compliance.
  • The Mexican market is complicated due to elevated number of federal and local regulations for alcoholic beverage's production, distribution, marketing and sale.
  • As Diageo has coordinated the TDJ, CASAMIGOS and other Tequila and Mezcal brands as business, there is a high need to integrate and reinforce the Code of Conduct, DMC, legal and procedures compliance in the business, among others.

Purpose of Role:
  • Provide legal counsel on the diverse matters related to the Tequila & Mezcal business.
  • Perform effective risk assessment for on the Tequila & Mezcal business.
  • Guarantee legal protection to the business.
  • Promote before adequate authorities a safer, helpful and just legal framework for the business.
  • Deliver the accurate legal framework that guarantees Diageo´s reputation as the most trusted and respected Company.
  • Negotiate appropriate contracts, documents, and positions representing the Tequila & Mezcal business


Accountabilities:
  • Design/draft of Contracts, agreements, processes, teamwork basis, communication memos for all business areas and all Diageo Companies, especially agreements implemented by Diageo companies with suppliers, customers, clients, counterparties, government and judicial authorities and other Diageo entities.
  • Design judicial strategies, studies and determinations on norms, taxes and administrative processes.
  • Verification of full legal compliance for every business activity, being active member of CARM team.
  • Provide legal opinions regarding business' legal framework.
  • Be responsible for and approve agreements, contracts and all other judicial document.
  • File complaints and litigations before accurate authority whenever Business needs require it (municipal, state and federal authorities).
  • Legally represent the company in all trial and administrative proceeding, before all accurate authorities.
  • Legal Counselling to all Diageo Companies in the world with regards to regulatory.
  • Manage external law firms.


Qualifications and Experience Required:

Crucial:
  • Bachelors in Law (at least 6 years of experience).
  • Strong communication skills
  • Strong public relationships capabilities.
  • Strong leadership capabilities.
  • Proficient Commercial, Public, Administrative, Corporate and Tax Law Knowledge.
  • Strong legal defense strategies crafting capabilities.
  • Analytical skills especially in complex situations where a timely and efficient solution is needed.
  • Integrity personality with self-confidence
  • English and Spanish skills


Desirable:
  • Postgraduate degree or equivalent experience in corporate, administrative or tax law.
