Job Purpose:

  • Under direction of Lead Counsel Commercial for the Asia Pacific cluster, the incumbent will provide legal support for CSL Behring's commercial activities in mainland China

Responsibilities:

Provide legal support for the commercial operations of CSL Behring in mainland China:
  • Review, draft and negotiate all strategic contracts required by the commercial operations function in the conduct of its business (except those which are the responsibility of the Enterprise Contracting Center) subject to CSL's Legal Policy, including but not limited to purchase and sale, distribution, agency, tender consulting advertising agency agreements; research, donation, sponsorship, and educational grant agreements.
  • Advise clients on strategic legal issues related to commercial activities, such as anti-trust, product promotion and education.
  • Supervise and manage litigation and litigation exposure to protect the interests of CSL Behring's commercial operations, in consultation with Lead Counsel Commercial APAC.
  • Learn, become familiar with, and stay informed on relevant legal and health care issues in order to proactively inform clients and help them anticipate and prepare for changes in the health care environment that may materially impact the business.
  • Partner with the Enterprise Risk Ethics and Compliance ("EREC") to help ensure business processes and activities are and remain in compliance with applicable laws, regulations, and company policies, and to maintain open and effective avenues of communication among Legal, EREC, and the business.
  • Serve as an escalation point for the Enterprise Contracting Center in relation to agreements within their area of responsibility that are required by the commercial operations function, and for the Legal Operations function.
  • Support related client groups including International Marketing, Medical Affairs, Market Access, Business Excellence & Commercial Development ("ABC"), including coordinating legal advice on a global basis, as needed.
  • Develop and deliver training on legal matters as required or requested.
  • Coordinate work with outside counsel as appropriate or assigned.
  • Establish and build good working relationships with internal clients based on mutual trust and respect and knowledge of the company's business and its needs and goals
  • Other duties as assigned from time to time

Qualifications:
  • Bachelor of Law degree obtained from a reputable university on a full time basis
  • Admissions to Chinese Bar
  • Deep and demonstrable legal experience (minimum of 8 years), with some demonstrated experience in supporting a pharmaceutical or medical device company, either as in-house or external counsel
  • Strong understanding of laws, regulations and industry guidance related to the pharmaceutical industry
  • Commercial acumen with a global mindset and a good understanding of the Chinese market
  • Leadership experience with ability to embrace and lead changes
  • Strong stakeholder management skills with the ability to influence at all levels of the organisation and to interface with management, commercial, customers and health authorities
  • Fluency in Mandarin and English (both in oral and written communication)
  • Excellent interpersonal, communications, public speaking and presentation skills
  • Independent worker (role will be remote from immediate manager)
  • Self-motivated, self-starter, results oriented
  • Ability to work in a cross-functional, cross-cultural matrixed environment
  • Able to work under stress and time pressure
  • Domestic travel required from time to time; infrequent international travel
