Summary:

The Capital Projects Commercial Director is responsible for managing procurement projects and commercial strategies to ensure the successful execution of contracts. This includes defining contractual strategies during the concept phase, preparing tender and contract documents to meet required standards, and securing procurement for investment projects on time and within budget. Additional responsibilities involve identifying and mitigating project risks through negotiated contract amendments, overseeing commercial management, and ensuring accurate project reporting. The Commercial Director also supports Ash Grove Cement's procurement objectives and commercial goals while managing multiple investment projects in the global cement industry.

This position involves preparing and negotiating various contract types, such as equipment procurement, design services, equipment design and supply, construction contracts, and EPC contracts. Contracts will be structured using local and international conditions, and sourcing will involve both national and international suppliers. The role requires building relationships with existing and new partners while focusing on priorities like cost reduction, quality improvement, innovation, value engineering, risk management, and detailed commercial reporting. These efforts aim to maximize value and opportunities for Ash Grove.

What you'll be contributing:

  • Promote and follow all aspects of safety guidelines (CRH safety 16 live Savings Rules) making sure all the designs are developed in accordance with the safety standard required, and participate in meetings as required.
  • Demonstrate integrity in all aspects of the role and promote the core values of the Company
  • Set a culture of continuous improvement.
  • Develop strong team working relationships and promote effective communication.
  • Strategy: define, develop and agree project delivery strategies (design, procurement and execution) in coordination with the engineering and execution teams.
  • Project Development: during project development, ensure that offers/estimates are aligned to scope. Identify and make appropriate allowance for all risks and opportunities.
  • Procurement: Coordinate with the procurement manager to ensure high-quality tender documents, (technical, commercial, and legal) are prepared and reviewed prior to issue. This includes ensuring that the contracts developed by the procurement department, in conjunction with legal, are properly prepared, reflect Group policy, and the agreed scope, and allocate risk effectively. Ensuring the procurement process (invitation to tender, offer return, analysis, and negotiations) is undertaken in accordance the over schedule by procurement department.
  • Contract Management: Ensure correct operation of the contracts by the project team during the execution phase ensuring contractual correspondence is compliant with requirements e.g. design submissions, communication, payments applications, compensation events (claims), and contract correspondence, approvals, records are managed properly. Oversee the final commercial negotiation and close-out of all contracts
  • Claim Management: manage disputes including:
    • Defining, with the Capex Leader and GTS the claims avoidance/mitigation strategy
    • Analyzing the root cause of claim events in accordance with obligations defined in the contract and actual events to determine the associated cost and time impacts and parties' entitlements.
    • Managing and updating the project risk register
  • Collaboration: work closely with the local business unit, project development team, procurement, legal, and other stakeholders to identify project risk, address procurement-related challenges, and achieve the project goals.
  • Provide leadership, strategic advice, guidance, and support to capex teams to achieve the successful development and delivery of the cement capex project pipeline.
  • Manage people, resources, and relationships efficiently.
  • Promote behaviours to influence the best performance, to improve the confidence and capability of the capex team.
  • Review specific training needs and ensure appropriate training is delivered to the capex team to maximise the potential of both the team and the individuals to ensure they provide an increasingly high-quality service.
  • Work collaboratively with the other senior managers within key stakeholder interfaces i.e. GTS and MTS.
  • Other duties as assigned by management.


To succeed in this position, you will need:

  • Bachelor's Degree in Engineering, Project management, or Construction Management.
  • Minimum of 10 years of experience in Engineering, Project management, or Construction Management. Extensive experience in all facets of project delivery, strong formative background in onsite construction and project management complemented by subsequent experience in estimating, tendering, negotiation, and commercial management. A proven track record in the delivery and/or commercial management of significant projects with a multi-disciplinary supply chain (OEM, Design Engineering, and Civil, Mechanical, and Electrical Contractors). Experience in the design & build environment, ideally with a Tier 1 national contractor. Prior experience in a main-contractor design & build environment. Experience in the cement industry is preferred.
  • Proficient in English written, verbal communication, and listening skills

  • Ability to professionally represent the company with external constituents
  • Knowledge of large project contractual risks and how to manage them
  • Ability to coordinate and develop innovative strategies and recommendations for initiating and establishing goals, timetables, and procedures
  • Ability to perceive risk across multiple dimensions and develop pathways to success in complex and multicultural environments
  • Ability to engage and influence multiple internal and external stakeholders
  • Ability to have confidence and fluency with contract drafting and administration
  • Ability to effectively manage multiple projects in parallel to the conclusion
  • Ability to continually develop professionally
  • Knowledge of construction costs, construction contracts, and planning control tools
  • Ability to confidently assess the risks
  • Travel up to 75%
