ADP is hiring a Sr. Director, Human Capital Management Counsel/Compliance

ADP Legal's Human Capital Management (HCM) Team is responsible for providing legal advice and compliance support to ADP's Global Product & Technology team and ADP's business units. The Senior Director will be an integral member of the HCM Team, responsible for providing advice on payroll matters, with a focus on wage and hour laws, as they relate to payroll, tax and time and attendance. This person will also be responsible for identifying the need for compliance programs and implementing and maintaining those programs for ADP's HCM compliance needs in our products and service offerings.

Essential Responsibilities:

  • Support all global ADP payroll products and business unit payroll service and implementation teams on HCM compliance matters.
  • Possess substantive knowledge related to wage and hour compliance, including the Fair Labor Standards Act, state and local equivalents and related regulations and how those laws impact wage payments, tracking of time and attendance, and downstream impact to payroll reporting and tax, with a willingness to grow and learn as we expand further to support global payroll.
  • Provide advice and guidance regarding compliance issues that arise in the business units, developing compliance programs as needed, coordinating performance of compliance responsibilities, and providing compliance training.
  • Interface with all levels of Global Product & Technology (GPT), ADP's business units (BUs), government relations and corporate management.
  • Act as a contact and team escalation point for compliance issues, coordinate performance of compliance responsibilities with BUs and provide necessary compliance training programs. Participate in client-facing compliance conversations as needed.
  • Exercise substantive judgment on taking risk-based approach for establishing and implementing HCM compliance requirements, provide general legal advice/guidance on questions/issues in assigned substantive compliance risk areas, and prepare any necessary work product to provide required guidance within ADP or to ADP clients.
  • Responsible for monitoring legal and regulatory developments in the relevant substantive areas of law.
  • Perform due diligence in substantive HCM compliance risks areas for potential new acquisitions and compliance reviews for potential new third party partners, applications or products.
  • Advise on changes in operational models for products and services which would minimize compliance risk, as well as business risk.
  • Experience in managing and writing compliance policies, communications and trainings programs.
  • Present on relevant compliance topics to associates and clients.
  • Some travel may be required.

We are open to someone working out of our Roseland, NJ, Alpharetta, GA or Miami, FL locations. We are working in a hybrid environment working in the office 3 days a week with the flexibility of working from home the other 2 days.

Qualifications:

  • Bachelor's degree and either a law degree (Juris doctorate) from an ABA accredited law school or significant experience as a payroll/HR manager.
  • If a lawyer, bar membership required (can be limited in-house counsel license in local jurisdiction).
  • 8-10+ years of legal practice, preferably with a top law firm or corporation OR 15+ years of experience as a payroll/HR manager.
  • Strong relevant wage and hour compliance experience, with expertise in employment/HR law, tax and applicable consumer protection laws a plus.
  • Experience with payroll products and design a plus.
  • Must possess strong compliance analysis and risk assessment skills and judgment, with ability to analyze new and existing laws and regulations, and apply those laws in a practical and risk-based fashion to operationalize business processes and procedures or establish and implement product requirements.
  • Must have strong writing skills with a meticulous attention to detail and form.
  • Proficiency with technology including Microsoft Office Suite (Excel, Word, Outlook, PowerPoint), SharePoint, and other support portal technology solutions.
  • Excellent communication skills and the ability to work under pressure and meet critical deadlines are necessary.
  • Must be a motivated self-starter with the ability to manage a transaction to completion and proactively anticipate issues or problems that may arise.
  • Must possess good interpersonal skills and be able to interface effectively with all levels of ADP management and associates and demonstrate ability to be assertive while maintaining diplomatic and professional demeanor.
  • Ability to work under pressure and meet critical deadlines.
  • Must have excellent time management and project management skills, be able to manage/prioritize multiple projects and balance quality with expedience.
  • Global approach with a desire and ability to work with people from different backgrounds and cultures.
  • Preference is for position to be based in Roseland, New Jersey; however, will consider certain other ADP locations such as Alpharetta, Georgia or Miami, Florida.
